1. Who we are
This website, isleofmansaltco.com (the "Website"), is operated by Isle of Man Sea Salt Company Limited (company number 134041C), trading as Isle of Man Sea Salt Co., of Headlands, Clifton Road, Port St Mary, Isle of Man, IM9 5EL ("we", "us", "our").
These Terms of Use, together with our Privacy Policy and (once published) our Cookie Policy, govern:
- your use of the Website and any account you create on it; and
- any order you place with us to buy products through the Website.
By using the Website, creating an account, or placing an order, you agree to be bound by these Terms. If you do not agree, please do not use the Website.
These Terms apply to retail/consumer orders placed directly through the Website. They do not apply to trade or wholesale accounts, which are governed by separate trade terms.
2. Changes to these Terms
We may update these Terms from time to time, for example to reflect changes in our products, the law, or how the Website works. The version in force at the time you place an order will apply to that order. We will post the current version on this page with an updated "Last Updated" date.
3. Using the Website
You agree to use the Website only for lawful purposes and in a way that does not infringe the rights of, or restrict or inhibit the use and enjoyment of the Website by, anyone else.
You must not:
- attempt to gain unauthorised access to the Website, our systems, or any account other than your own;
- use the Website to transmit any harmful code, or attempt to disrupt or overload it;
- use any automated system (e.g. bots or scrapers) to access the Website without our written permission;
- copy, reproduce, or republish content from the Website (including images, text, and our branding) without our permission.
4. Your account
To place an order or view order history, you may need to create an account, providing accurate and up-to-date information (see our Privacy Policy for how we use this).
You are responsible for:
- keeping your account password confidential;
- all activity that happens under your account;
- telling us promptly at hello@isleofmansaltco.com if you believe your account has been accessed without your permission.
We may suspend or close an account if we reasonably believe it is being used fraudulently, abusively, or in breach of these Terms.
You can ask us to close your account and delete your data at any time, subject to our legal obligation to retain certain order/tax records (see our Privacy Policy).
5. Products
We make every effort to display our products, descriptions and images accurately. However:
- slight variations in colour, texture or weight may occur, as our products are hand-harvested and hand-packed;
- we may occasionally need to substitute packaging or make minor recipe adjustments without notice, provided this does not materially change the product;
- product availability is not guaranteed until your order is confirmed.
Allergen and dietary information: full ingredient information is provided on product pages and packaging. If you have a food allergy or intolerance, please check the label carefully before consuming, or contact us at hello@isleofmansaltco.com if you have any questions before ordering.
6. Placing an order
- Orders are placed by adding products to your basket and completing checkout.
- There is no minimum order value or quantity for retail orders.
- Your order is an offer to buy. We will send an order confirmation email, but this does not mean we have accepted your order. A contract is only formed once we send a dispatch confirmation (or otherwise notify you we've accepted the order).
- We may decline or cancel an order (in whole or part), for example if a product is out of stock, if there's been a pricing or listing error, or if we suspect fraud. If we do, we will notify you and refund any payment already taken for the cancelled item(s).
7. Price and payment
- All prices are shown in GBP and, where applicable, are inclusive of any VAT payable.
- We take reasonable care to ensure prices are correct, but if we discover a pricing error on an order you've placed, we will contact you before dispatch to confirm whether you wish to proceed at the correct price, or cancel.
- Payment is taken securely through our payment provider, SumUp, at the time you place your order. We do not see or store your full card details; see our Privacy Policy for more.
- Delivery costs (if any) will be shown clearly at checkout before you complete your order.
8. Delivery
- We currently deliver to addresses in the Isle of Man and United Kingdom only.
- Estimated delivery times will be shown at checkout or in your order confirmation. These are estimates, not guaranteed delivery dates, and may be affected by factors outside our control (see Section 12, Events Outside Our Control).
- Risk in the products passes to you once they are delivered to the address you provided.
- If a delivery goes missing or arrives damaged, please contact us at hello@isleofmansaltco.com as soon as possible, ideally with photos, so we can help resolve it.
9. Your right to cancel (Consumer Contracts Regulations)
As a consumer buying online, you generally have a legal right to cancel your order and receive a refund within 14 days of receiving your goods, without giving a reason, under the Consumer Contracts (Information, Cancellation and Additional Charges) Regulations (as applied in the Isle of Man) or equivalent UK legislation.
To cancel, contact us at hello@isleofmansaltco.com within the 14-day period, clearly stating your order details and that you wish to cancel.
Important exceptions for food products: because our products are food items, this right to cancel does not apply once a product has been unsealed/opened, or where the goods are, by their nature, not suitable for return for hygiene reasons. This means:
- Unopened, unused products in their original condition can be returned within the 14-day period for a refund.
- Once a jar or pack has been opened, we're unable to accept it back for hygiene and food safety reasons, except where the product is faulty or not as described (see Section 10).
If you're returning goods, you are responsible for the cost of returning them unless we sent you the wrong item or the item is faulty. We recommend using a tracked service, as we can't take responsibility for returns lost in transit.
Condition of returned goods: to qualify for a refund, products must be returned unopened, unused, and in the same condition in which you received them, with no damage or alteration to the product or its packaging. We may make a deduction from your refund if the value of the goods has been reduced as a result of handling beyond what's necessary to establish their nature and condition, for example if a seal has been broken or the product shows signs of use.
Refunds will be made to your original payment method within 14 days of us receiving the returned goods back undamaged and unaltered (or evidence you've sent them, if earlier).
10. Faulty, damaged or incorrect items
If a product arrives damaged, faulty, or different from what you ordered, please contact us at hello@isleofmansaltco.com as soon as possible with your order number and, where possible, a photo. Depending on the situation, we will offer a replacement, refund, or other resolution, in line with your statutory rights as a consumer. This is in addition to, and not affected by, the cancellation rights in Section 9.
11. Our liability
- We are responsible for foreseeable loss or damage caused by our failure to comply with these Terms or by our negligence, but we are not responsible for loss or damage that is not foreseeable, or for indirect losses (e.g. loss of income) that were not obvious to both of us when you placed your order.
- Nothing in these Terms excludes or limits our liability where it would be unlawful to do so, including for death or personal injury caused by our negligence, or for fraud.
- We are not liable for delays or failures caused by events outside our reasonable control (see Section 12).
12. Events outside our control
We won't be liable for any delay or failure to perform our obligations if that delay or failure results from events outside our reasonable control, such as extreme weather, strikes, transport disruption, or supply shortages. If this happens, we'll contact you as soon as reasonably possible and, where the delay is significant, you may cancel the affected order for a full refund.
13. Intellectual property
All content on the Website, including our name, logo, product photography, packaging design, and written content, belongs to us or our licensors and is protected by copyright, trade mark and other intellectual property laws. You may view and download content for your own personal, non-commercial use, but must not otherwise copy, reproduce, or use it without our written permission.
14. Privacy
Our Privacy Policy explains how we collect and use your personal information, including account, order and marketing data. It forms part of these Terms, so please read it.
15. Complaints
If you're unhappy with your order or our service, please contact us first at hello@isleofmansaltco.com so we can try to put things right.
16. Governing law
These Terms, and any order placed through the Website, are governed by the laws of the Isle of Man. If you are contracting with us as a consumer resident elsewhere (e.g. the UK), you may also have the benefit of mandatory consumer protection laws in your own country of residence, which are not affected by this clause.
17. General
- If any part of these Terms is found to be unenforceable, the rest will continue to apply.
- If we don't enforce a right under these Terms on one occasion, that doesn't mean we've given up that right.
- These Terms, together with our Privacy Policy and Cookie Policy, form the entire agreement between you and us in relation to your use of the Website and any order placed through it.
